职务犯罪侦查措施体系的构建

摘　　要：我国现有职务犯罪侦查措施单一、强制力不足、侦查效能低下,严重影响职务犯罪侦查权的行使。建议构建职务犯罪侦查措施体系。从超前性、层次性和可行性的总体设想出发,应修改现行法律设置的"普通侦查措施",增设强制取证、技术侦查、诱惑侦查、特情侦查等"特殊侦查措施",构建职务犯罪侦查措施体系,以促进侦查措施法律功能的整体有效发挥,满足惩治职务犯罪紧迫形势的需要。Some disadvantages existing in current investigation of the official crimes such as too simple investigatory measures, insufficiency of compulsory force, and low efficiency counteracted the effect of the investigation power. An investigation measures system against the official crimes should be constructed to ensure that the investigation organ is capable of punishing the official crimes by taking appropriate measures within its statutory authority. In view of the prospectiveness, hierarchy and feasibility of the system, general investigation measures in current law should be amended by adding several special investigation measures such as compulsory evidence obtaining, technical investigation, entrapment investigation, and informer investigation to advance the effectual exertion of the function of investigation measures and satisfy the urgent demand of official crime control.
