摘　　要：德国社会保障的法制化建设具有战略意义,公平基础上的团结互助和自我负责成为社会保障立法的指导原则,社会保障法律制度构建凸显人权与人文精神,制度合理配置政府行为与市场选择,农村社会保障法律制度自成体系。这些制度安排都显示了德国模式的成熟性,值得我们吸收借鉴。应该创建城乡和谐发展的社会保障法律体系。Germany＇s legal construction of social security is of strategic significance. Solidarity and self- responsibility on the basis of fairness are the guiding principles for building a legal system for social security, which focuses on human rights and humanism. The system allocates the government behavior and market choice rationally. The legal system for social security in rural areas is a system by itself. All of these system arrangements have shown the maturity of German model, our country should absorb and use the experiences for reference and construct a social security legal system for the harmonious development of urban and rural areas.
