摘　　要：从平衡旅行社、保险公司、第三人之间的利益出发,以保障第三人获得迅速、实际的赔偿为落脚点,借鉴其他国家和地区的立法经验,在旅行社责任保险中,我国立法应赋予第三人直接请求权且不宜对第三人直接请求权的行使附加任何限制条件。In order to balance the interest of travel agency, insurance company and the third party, and to ensure that the third party could get rapid and effective compensate, the third party should be granted the direct instruct without any attached limited conditions by legislation in travel liability insurance.
