摘　　要：在我国,立法完全排斥刑事领域的精神损害赔偿,这导致刑事被害人精神损害保护缺失,剥夺了刑事被害人精神损害赔偿请求权。因此,应当通过修订完善《刑法》有关损害赔偿的规定,完善《刑事诉讼法》有关损害赔偿的程序规定,并制定《国家补偿法》,以保护刑事被害人的合法权益。In our country, the legislation of the compensation for moral damage in the civil field is different from that in the criminal field, the legislation has completely excluded the compensation for moral damage in the criminal field. This has led to the lack of protection of the criminal victims＇ moral damage, depriving the claims of the criminal victims＇ the compensation for moral damage. As a result, legislation should be adopted to improve the provisions on the compensation for damage in ＂Criminal Law＂, to improve the procedural provisions on the compensation for damage in ＂Criminal Procedure＂, and to establish ＂national compensation law＂ to protect the legitimate rights and interests of the criminal victims.
