摘　　要：我国学者从捐赠人与受益人关系角度研究社会募捐行为,认为社会募捐行为是民事法律行为。这种研究视角和观点很难解决募捐余额归属和政府对社会募捐监管问题。应从募集人角度以行政法研究方法分析社会募捐行为。社会募捐行为是公务行为,是获得授权的特定组织为公益目的而开展的财产募集活动,应当符合公务行为规则的要求。contribution is Studying from the relationship between contributors and the contributed, social solicit regarded as a civil juristic act by Chinese scholars. solve problems of balance ownership and social supervision of social solicit contribution. Therefore, the research method of administrative law should be introduced into. From the angle of the soliciting person, social solicit contribution should be regarded as a public function, i.e. property particular authorized organizations for a public purpose, which should be in soliciting activities developed by accordance with public function regulations.
