摘  要:商标窃权是近年来在我国新出现的一类商标侵权案件,但在现行商标法中,法律却并未对由此引发的权属纠纷作出规定。本文认为,传统民法中的善意取得制度不适用于解决商标窃权案件中的权属纠纷。但从充分维护消费者利益的角度出发,法律在承认商标失权人有权追回商标权的同时,还应允许善意受让人在特定条件下对商标的继续使用。The theft of trademark right is a new category of trademark torts in our country,but there is no regulation in trademark law to resolve the dispute between the sufferer and the third party who has obtained the right from the thief.This article holds that the institution of acquisition in good faith of civil law can not be applied to resolve the controversy.To protect the consumer’s interest,trademark law should acknowledge the sufferer can recover his right,but at the same time,the law should allow the the third party who acquire the trademark right in good faith has the right to use the trademark continuously in the specific conditions.
