摘 要:对森林资源管制是现行各国的通例,但管制与行政补偿国别差异很大。一般是合理管制不补偿,过度管制给予补偿。域外法把过度管制称为管制性征收,纳入公用征收范围。通过研究,文章认为大部分生态公益林管制属于管制性征收,应补偿林地、林木损失和提供安置补助,并对现有补偿制度和政策提出了完善建议。Difference of administration compensation for regulation is large in countries, although that is usual practice in the world about regulatory for forest resource. Administration compensation is commonly granted to excess regulation not natural regulation. Excess regulation, called regulation takings, belongs to public expropriation internationally and can obtain administration compensation. The paper judges that a majority of protection forest remain with regulation taking, which compensate woodland and trees and afford employment. Than, advise to reform the system and police for the protection forest.
