从非婚同居现象看我国婚姻制度的立法缺陷

摘　　要：我国非婚同居现象日益突出,由于其不受相关法律规范,引起了大量的社会纠纷。要树立人们对婚姻的信心,应建立婚前财产保护制度,设立婚姻教育制度和示范性的契约婚姻制度,建立维护完整婚姻和保障离婚自由的价值平衡机制,通过完善这些相关制度以减少非婚同居现象的发生。The phenomenon that persons live on tally becomes increasingly commonplace. The conflicts related with this kind of relationship come out frequently for the law does not regulate them. The belief for marriage should be reconstructed. The marriage education institution and contract marriage institution should be built up, the institution that the property before marriage should be protected. Establishing the value balance mechanism to maintain the marriage and protect the freedom of divorcement. The phenomenon that persons live on tally can be reduced by improving the relative institution.
