摘 要:集体协商是我国调整劳动关系的重要形式,政府在集体协商中的地位和作用是有关劳动关系协调的重大问题。按照各国惯例,政府在集体谈判中主要充当促进者、服务者的角色。基于我国现实国情的考虑和路径依赖,形成了"党政主导"的集体协商模式,政府不仅通过立法,对集体协商程序、集体合同内容进行限定,还直接介入集体协商过程、介入集体协商争议的处理,更为重要的是集体协商的发动有赖于政府推动,工会的自主协商动力相对缺失。劳资自治被抹杀。为此,亟需澄清认识,改革现行法制,重塑政府、用人单位、工会的关系,对工会进行民主化改革,确立工会的自主性和独立性,重构我国集体协商机制。The collective bargaining is an important form of labor relations coordination in our country, and the Government's position and role in collective consultation is the important issue concerned about coordination of labor relations. China is carrying out "governmentled" model of collective bargaining. The Government not only through legislation limits the collective bargaining procedures and the content of collective contracts, but also is directly involved in the process of collective bargaining and the dealing with collective bargaining controversy, so trade unions lack the power of independent consultation. Therefore, it is urgent to clarify the awareness, reform the existing legal system, reinvent the relations between Government, employers and labor unions, carry out democratic reform for trade unions, establish the autonomy and independence of trade union, and reconstruct the collective consultation mechanism.
