摘　　要：数字技术为图书馆发挥其功能创造了巨大的潜力,但传统著作权制度中合理使用的狭小范围和法定许可的缺失严重制约了数字环境下图书馆功能的充分发挥。为此,世界各国立法开始进行新的探索,学术界也提出了建设性的意见。合理扩充著作权合理使用的范围和引入法定许可制度是可行的图书馆馆藏资源数字化利用的著作权解决方案。While the digital technology creates huge potential for libraries to play their role, the narrow scope of the fair use and the lack of a statutory licensing system seriously limited the function of libraries under the condition of new technology. Therefore, legislations and the academic began to explore the copyright resolution for the use of library＇s digital resources. To expand the scope of the fair use reasonably and introduce the statutory licensing system into copyright system is the feasible solution for the use of library＇s digital resources.
