摘　　要：司法鉴定实践中,不当鉴定的情形不可避免地存在。损及司法鉴定当事人权益的不当鉴定行为必然使鉴定人承担相应的责任,而民事责任是不当司法鉴定人责任体系的核心内容。为解决司法鉴定人民事责任,切实保护司法鉴定当事人的合法权益,应突破众多阻滞因素,完善相关制度,建立司法鉴定人执业保险体制。Improper appraisal is inevitable in judicial practice. An appraiser whose improper appraisal infringes the party＇s interest mast undertake the responsibility, and lhe civil liability is the core of appraisers＇ responsibility system. To determine the civil liability of the appraiser and protect legitimate rights and interests of litigants, it is necessary to build up and perfect an insurance system of appraisers＇ practice.
