论单位共同犯罪的主体范围

摘　　要：单位共同犯罪的主体包括单位和自然人。非法成立的组织和合法成立后以犯罪为主要活动的组织以及名义被盗用的组织不具有单位犯罪包括单位共同犯罪的主体资格,而所有制形式和成员人数的多寡不能被用作单位犯罪包括单位共同犯罪主体资格的判断标准。单位内部的自然人可以个人身份而与所在单位共同实施单位共同犯罪,而单位外部的自然人可在单位的"犯罪代理权限"内或经单位事后追认而与单位共同实施单位共同犯罪,乃至构成单位共同犯罪中的"片面共犯"。The subject of unit joint crime includes unit and natural person. Illegal organizations and legally founded organizations majoring in crime as well as organizations whose name is embezzled do not have subject qualification of unit crime, including unit joint crime, and the form of system of ownership and a- mount of members can not be used to judge the norm of the subject qualification of unit crime, including u- nit joint crime. A natural person in a unit can commit a unit joint crime with a unit, while a natural person outside of a unit can commit a unit joint crime with a unit within delegated authority of a crime or after being confirmed subsequently by a unit ,or make himself be a one-sided accomplice in a unit joint crime.
