我国司法解释制度改革路径探析——以《澳门刑事诉讼法典》“统一司法见解制度”为视角

摘　　要：近年来,对我国司法解释制度进行改革的呼声在法学界日渐高涨,但一直没能在实践中有所突破。《澳门刑事诉讼法典》中的统一司法见解制度融合了两大法系在适用法律方面的制度优势。它专门为统一法官对法律的不同解释而设立,在功能上与司法解释类似;又由于该制度根植于个案之中,对我国目前"同案不同判,同法不同解"现象有很好的遏制作用;且该制度符合我国目前的制度构架和司法技艺:值得我国在司法解释制度改革中予以借鉴。Recently, opinions on the reform of judicial interpretation system in our country are constantly heard in the jurisprudential circle. However,no prominent improvement in practice has been made so far. The Unification of Judicial Decisions System in ＂Criminal Procedures Law of Macao＂ bears the advantages of both civil law and common law. With a function similar to the judicial interpretation,it＇s constituted for the very purpose of unifying the different judicial interpretations, preventing different decisions of the same case when applying the same laws. This system also accords with the institutional structure and judicial technique at present ,thus it should be used for reference in the reform of judicial interpretation system in the interior of our country.
