摘　　要：行政事实行为是与行政法律行为相对而言的一类行政行为,对外不具有法律效力,但是可能对行政相对方的权利和义务造成实际的影响。从外延来看,包括行政机关的日常建设和维持行为、执行性行为、咨询和通告行为、非正式行政行为和违法的暴力侵权行为。Factual administrative act, in contrast to act in law ,is a kind of administrative act ,which is of no legal validity ,but would substantively affect the rights and duties of citizen ,legal person and other entity. Factual administrative act covers the daily act of construction and maintenance,the act of execution , the act of consultation and information , the informal administrative act as well as violent tortuous act of the administrative agency.
