摘 要:我国转型时期政府决策权滥用的原因是多方面的,如同其他行政权力一样,政府决策权如果缺乏法律的监督和制约,就可能成为脱离社会的力量,造成国家、组织和公民的损失,带来广泛的社会影响。政府决策法治化应遵循决策学的主体限制原理、程序限定原理和行为控制原理。构建政府决策权的制约机制,就要建立政府决策失误责任法律追究制度、规范和优化政府决策程序和完善政府决策监督体系,使各种制约因素相互衔接、相互配合、相互支撑、形成合力。During China's transition period, the reasons of abusing the government decision-making power are many aspects. Just like other administration power, if government decision-making power is lack of legal supervision and restriction, it'll possibly break away from society , cause country, organizations and citizens losses, and bring about widespread society influence. Government decision-making of ruling by law should follow subject limit principle, process limit principle and action limit principle. Establishing government declsion-maklng restriction mechanisms should establish the legal system of responsibilities investigating of government decision-making errors, standardize and optimize the process of government decision-making and perfect the supervision system of government decision-making, making various supervision factors joined, cooperated and sustained each other forming joint force.
