摘　　要：论述了医疗侵权的概念与特点,阐述了医疗侵权不同于特殊民事侵权行为,应属一般侵权行为,适用过错责任原则,介绍了申请医疗事故鉴定是患者举证的重要形式,并提出了侵权责任法的相关修改建议。Concept and characteristics of medical tort is introduced. The gaps between medical tort and special civil tort are compared and find that medical tort doesn＇t belong to special civil tort and belong to general civil tort. So the principle of fault liability is fitted. Applying medical identification is an important approach for protecting patients＇ rights. Suggestions on revising tort reliability law are mentioned.
