摘　　要：分析了专利权资本化的定义和作用,并从法律规定和政策支持两方面说明了我国专利资本化的法律规制,在此基础上讨论了专利资本化的方式、条件和现状。最后,建议加强相关立法,从制度上保证专利资本化的顺利实施。This paper analyzes the definition and functions of capitalizing patent, illuminates regulations of capitalizing patent from two aspects of laws and government＇s policy, then discusses the ways, conditions and present situations of capitalizing patent. The author finally makes suggestions that legislation should be reinforced to be sure that patents can be smoothly capitalized.
