摘　　要：新刑种的增设应取决于刑罚目的的需要和社会发展的需要。我国现行刑罚体系监禁刑偏重,妨碍了刑罚功能的有效发挥,应在总结我国刑罚实践经验的基础上,借鉴国外先进的立法经验,增加非监禁刑刑罚种类,如:社会服务刑,劳动教养刑,并进一步丰富资格刑的种类。The addition of new types of penalties should depend on the needs of penalty purpose and social development. Chinat current penalty system emphasizes on imprisonment, which hampers effective penalty function. We should, drawing advanced legislative expe- riences from other countries, establish non-custodial penalty types on the basis of practical experience, such as social services and re- education and further establish types of qualification penalty.
