摘  要:城乡二元土地制度及相应的土地管理制度,不断上扬的房价,农民维权意识的增强,城市化过程中住房需求的增加,地方政府管理缺位等是"小产权"房产生的原因。"小产权"房市场中存在着农地发展权缺失问题。虽然我国的土地有国家所有和集体所有两个产权主体,但是这两个主体的地位是不可比的,农村集体土地所有权没有最终处分权,国家可以动用征地权来获取集体所有土地,甚至通过行政力量侵犯农村集体土地的经营收益。因此,确保农民利益的最佳途径就是让农民真正完全享有农村集体土地所有权,实现国有与农村集体土地同地同权。The paper first analyzes the major reasons why the 'small property rights' house has emerged,these are: dual urban-rural land system and the corresponding land management system;the continuous rise in prices,farmers has become more aware of protecting their legitimate rights and interests;the process of urbanization has increased the demand for housing;as well as the poor management of local government.The paper goes on to introduce that although we have state and collective ownership of land,the status of these two subjects is not comparable.There is no final disposition of collective ownership of land in rural areas.State can obtain the collective ownership of land by using the right of land expropriation and requisition;and even infringe the management and profits of collective land in rural areas via the administrative power.Therefore,the best way for ensuring the interests of the farmers is to make the farmers fully enjoy the collective ownership of rural land,and finally reaching the situation that rural collective land has an equal right with state-owned land.
