关于强令违章冒险作业罪客观要件认定的若干问题探析

摘　　要：强令违章冒险作业罪,在客观方面,"强令"行为一般情况下要求有明示或暗示的强迫行为,但如果强令的对象为新工人,或采用迷信欺骗的方式令工人违章冒险作业则不要求有一这形式要件;"违章冒险作业"中"章"的范围应仅为成文的规章制度,习惯和惯例不能成为本罪空白罪状的刑法规范组成部分;"其他后果"应既包括显性的突发后果,也包括隐性的徐行后果。Compels violates regulations to take risk work crime is an accident, heavy casualties happened as a result or the behavior bring about other grave consequence. Make behavior demand to have expressing under ordinary circumstances or telegraphic ＂in the field of objective, by force＂ forcing behavior, not demanding to have this one form important condition, for a new worker, or adopt the school assignment blindly believing that the way cheating makes a worker take risks against rules; The ＂rules＂ range should be the existing writings rules and regulations only, habit and convention can not become the standard ingredient of crime blank space charges in an indictment corporal punishment in ＂taking the risk of school assignment against rules＂; ＂Consequence responds to other＂ now that dashing forward including a dominance sends out consequence, walking slowly also induding a recessiveness consequence.
