摘 要:采用案例分析法对体育名人作为公众人物在名誉权和隐私权方面受到的限制进行研究,解决体育媒体侵权的相关法律问题。体育明星因其特殊才能、成就和表现,具有较高的社会知名度,有广泛的社会影响力,成为公众瞩目者也就是"公众人物"。我国现行法律并无公众人物的法律规定。但我国司法实践已经逐步倾向于将体育名人视为"公众人物",为了维护公众利益,对其名誉权和隐私权加以限制。根据美国的判例,判断运动员或裁判是否是公众人物的主要因素包括参加的比赛等级,参与的年限,比赛是否被转播,当事人在某一项目中的声望等。虽然美国司法判例确定了"一旦成为公众人物永远是公众人物"的原则,但在体育名人名誉权隐私权案件中法官并非直接适用,而会根据当事人的具体情况来判断。This paper is a study on the limitation of the right of reputation and privacy for sports celebrities as public figures by means of case study for the purpose of solving relevant legal issues of torts by sports media. Because of their special talent,achievement and performance,sports stars are highly well-known, have extensive social influences and become famous public figures. Currently,there is no such legislation regarding the rights of public figures in China. But current legal practice has the tendency to regard sports celebrities as public figures in China,in order to protect the public interests and the right of sports celebrities. According to the legal cases in USA,the main factors to decide whether a sportsman or a judge is a public figure depends on the level of competition they participate, duration of participation, whether the game is broadcasted and the fame the participant has in a certain event, etc. Although the American legal Legislation has established a principle of 'once a public figure,always a public figure' ,it is not applied directly in the case of sports celebrities' right of reputation and privacy,but judged by the actual details of the person in case.
