摘　　要：随着医疗科技的发展和医疗体制的改革,在实际医疗活动中出现了大量不作为侵权现象。而从现行法律法规以及相关理论研究来看,存在重医疗作为侵权轻医疗不作为侵权的现象。引起此现象的原因主要是因为医疗不作为侵权的认定、判断难,医疗不作为的归责难以及医疗不作为侵权的防范难等方面。With the development of medical technology and health care system reform, there are a large number of violations of nonfeasance in the actual medical activities. From the existing laws, regulations and the relevant theoretical research, the violation of medical nonfeasance weighs over the violation of medical feasance. This phenomenon is mainly caused by the difficult identification and censure of violation of medical nonfeasance, as well as the prevention to the violation of medical nonfeasance.
