摘　　要：本文先从法理上论证法律与习惯的内在关联性,然后再从历史维度考察两者的演化渊源,进而得出结论:法律与习惯不仅要相互尊重、相互补充,更是可以互动的。基于此判断,本文主张以互动性为基点,以"法律习惯化与习惯法律化"为主线,重述习惯与法律之关系。法律习惯化就在于法律应该具有习惯的习俗化面向、生活化面向、民意性面向、本土化面向。其目的在于:赋予法律以习惯的内容,赋予法律习惯的特性,以此构筑法制现代化的"依赖路径"。习惯法律化即是习惯向法律转化或借助于法律从而使习惯的功用得到更大的发挥,在当下中国,它主要通过纳入和转化两种方式实现习惯法律化的。其目的在于:使习惯的功用借助于法律得以"硬化"或最大化,使习惯的价值与精神得以与法律相通或重构。两者融洽的效果应该是:法律经由习惯、习惯通过法律而共同构织人类生活的意义之网。This article proves legal and the custom intrinsic relatedness first from the legal principle theory of law, then inspects beth＇s evolved origin again from the historical dimension, then draws the conclusion： The law and the custom not only need respect mutually, supplement mutually that is may interact. Based on this judgment, this article advocated that take interactive as the basic point, take ＂the legal habituation and the custom legalization＂ as the master line, the iteration custom and the legal relations. The legal habituation lies in the law to have the custom conventionalization face, the adaptation face, the public opinion face, the localilzation to face. Its goal lies in： Entrust~ with the law by the custom content, entrusts with the legal custom the characteristic, by this construction legal system modernization ＂dependent way＂. The custom legalization is familiar with to the law transforms or draws support the law, thus enables the custom the function to obtain a bigger display, in China, it mainly through integrates and transforms two ways immediately to realize the custom legalization. Its goal lies in： Enables the custom the function with the aid in the law ＂the hardening＂ or the maximization, causes the custom the value and the spirit can be interlinked or restructuring with the law. Both harmonious effect should be： Law by way of custom, custom through law, but altogether the isomorphism weaves network which of the significance the humanity lives.
