婚内侵权损害赔偿问题新探

摘　　要：围绕婚姻法解释(一)第29条的规定,法学界掀起了关于婚内侵权损害赔偿问题的激烈争议,观点针锋相对。文章对婚内侵权损害赔偿的否定观点作了批驳,指出实施婚内侵权损害赔偿体现了法治社会的公平和正义,是贯彻男女平等基本国策的需要,既促进婚姻家庭稳定和社会和谐,又维护了法制统一。2008年公布施行的《物权法》和将要出台的侵权责任法为婚内侵权损害赔偿带来了新的曙光,为此,文章对婚内侵权损害赔偿制度提出了几点可行性建议。The 29th clause of the first judicial interpretation on Marriage Law , causes a fierce debate among legal scholars about compensation for spouse＇s tort during marriage. The thesis vetoes the negative view, points out that enforcing compensation for spouse＇s tort reflects the equity and justice of legal society, is the need of implement of the national policy on equality between men and women, accelerates a stable marriage and family and a harmonious society, and protects the unity of legal system. For the Real Law promulgated in 2008 and the Tort Law being prepared to enact will give us new hope on compensation for spouse＇s tort, the paper raises some advises to establish the system of compensation for spouse＇s tort.
