摘　　要：运行至今14年的《国家赔偿法》,自2008年10月28日至11月30日修正案草案公开向社会征求意见以来,法学界的修订建议不断,多位专家表示,若不进行系统性修正,从长远看势必影响法律的尊严与长期适用性,其中一个重大缺陷就是对与物质损害赔偿制度相适应的精神损害赔偿制度的规定甚少,存在诸多缺漏。精神损害赔偿制度的建立和完善体现了社会的进步,人们自主意识的增强和现代法律对人权的关注和保障,是社会正义和效率的要求。14-year run since the ＂State Compensation Law,＂ 2008 October 28-November 30 draft amendments to solicit opinions openly, the proposed amendment jurisprudence constantly, many experts said that if no systematic amended, in the long run is bound to affect the dignity of the law and long-term applicability, which is a major flaw and material damages to the system to adapt to the spirit of damages little system, there are many gaps. Damages the spirit of the establishment and improvement of the system reflects the progress of society, it is self-awareness and modern law of human rights concerns and the protection of social justice and efficiency.
