摘 要:技术侦查手段能否在职务犯罪中运用存在一些认识问题及制度障碍,然而技术手段在职务犯罪侦查使用具有合理性和正当性,应当允许使用。技术手段属于强制措施可能侵犯公民的基本权利,因此在使用时也应遵循几个基本原则,如程序法定原则、合目的性原则、最底限度使用原则以及权利救济原则等以保障其合理使用。同时,在现行制度下检察机关使用技术侦查手段还要注意防止不适当的侵犯职务秘密和个人隐私,强化自我约束并接受外部监督。There are some system obstacles and understanding problems on whether technology means can be used in the job-related crimes. Since using technical means in the job-related crimes has rationality and legitimacy, they should be allowed. Technical means are coercive measures which might infringe the fundamental rights of citizens, so they should be used under some of the basic principles to be followed in order to safeguard its rational utility. At the same time, under the existing system, the prosecution would also pay attention to prevent the inappropriate violations of duty secrets and personal privacy, and strengthen self-discipline and accept external oversight.
