承认外国法律效力问题的进化博弈分析

摘　　要：基于传统方法对于"承认外国法律效力"(以下简称"承认")的分析的局限性,我们看到进化博弈的四个阶段:"承认"行为的形成、"承认"规则的形成、"承认"规则导引下的行为和"承认"均衡的形成,可以看出"承认"本身也是一种制度均衡,进而可以说"国际私法的理论内核是‘进化’"。The evolutionary game theory analysis of the admission of foreign law （AFL） was divided into four stages, including the formation of the acts of AFL, the formation of the rules of AFL, the acts under the guidance of rules and the balanced formation about AFL. The conclusion is that AFL itself is a kind of institution balance and the theoretical core of Private International Law is ＂evolutionary＂.
