摘　　要：现行刑法较之79刑法具有巨大的进步意义,其表现之一即是实现了刑法基本原则的法定化和明确化。但通过考察不难发现,刑法明确规定的三项基本原则的法律实效还有一些不足,为完善这些基本原则,需要采取相应措施。The present Criminal Law has made a great progress compared with the criminal law of 1979. One of the progresses is that its basic principles are legalized and defined. However,it＇s not difficult to discover through inspection that there are still some defects in actual operation that the three basic principles stipulated by criminal law. Therefore, corresponding measures should be adopted to perfect these basic principles.
