摘  要:媒体广告违法行为的泛滥,严重影响了我国的广告市场秩序。为了维护广告市场秩序,本文从立法角度对媒体广告违法行为的原因和对策进行分析。立法的不完善是广告违法行为的重要原因。广告立法的不完善表现在:广告法律规范之间存在比较严重的内部冲突,发布违法广告的法律责任过轻,广告诉讼制度不完善。在分析原因的基础上,提出了完善广告立法的对策:进行广告法典编纂,完善广告法民事责任制度,完善行政法律制度和建立代表诉讼制度。The advertisement market order has been affected gravely by Medium' s illegal advertisement activities in China. In order to defend advertisement order, the essay analyzes causes and countermeasures of medium' s illegal advertisement activities, The legislative defect is the most important cause of medium' s illegal advertisement activities. For example, there are lots of legal conflicts among advertising rules, and there is little legal responsibility to illegal advertisement, and advertisement legal action system is not perfect. Based on analysis to these causes above, the essay puts forward some countermeasures to advertisement legislation: the Advertisement Law should be amended, and civil liability breaking the Advertising Law should be amended too, and in the mean time, the administrative system should be rebuilt and the representative of the system should be established.
