摘　　要：我国基于当时的社会情况,颁布了强调养老育幼社会功能和保护继承人继承权的继承法,却缺乏对遗产债权的保护,遗产债权的保护与继承法的社会功能和继承人利益的矛盾越来越突出,为求得两者的平衡,很有必要引入遗产破产制度。在对遗产破产的概念、遗产破产能力、遗产破产的名称和立法例、遗产破产申请的条件等问题进行探讨的基础上,再进一步完善我国的继承和破产法治。Based on the social situations, Inheritance Law, emphasizing on the social function, lacks the protection of inheritance credit, which causes the conflicts between the social function and the inheritor＇s interest. It is ,necessary to introduce the inheritance bankruptcy system in order to keep the balance. On the basis of exploring the definition of inheritance bankruptcy, the ability of inheritance bankruptcy, the terms and the legal case of inheritance bankruptcy and the application conditions of inheritance bankruptcy, we can improve the inheritance and bankruptcy law system in our country.
