再论国际经济法学的基石范畴——一个跨国经济(公)法的视角

摘　　要：国际经济法学基石范畴是指跨国经济(公)法诸主体的权利(权力)。私人享有跨国经济规制法上的私人财产权利,国家享有跨国经济规制法上的国家规制权力,国家享有国际经济消极共存法上的国家主权权利,国家享有国际经济规制协调法上的国家交往权利。跨国私人经济财产权利和跨国国家经济规制权力表征了私人与国家之间的跨国经济规制法律关系,跨国国家经济主权权利表征了国家与国家之间的国际经济共存法律关系,跨国国家经济交往权利表征了国家与国家之间的国际经济规制协调(亦即合作)法律关系。这四种权利(权力)范畴完整地揭示了跨国经济(公)法法律主体及其法律关系和法律体系,我们可以以这四种基石权利(权力)范畴构建一个健全完善的跨国经济(公)法意义上的国际经济法学学科体系。The cornerstone categories of international economic law science refer to various rights and powers of different types of international economic law subjects. Private persons have private property rights in transnational economic regulatory law, states have national regulatory powers in transnational economic regulatory law, states have national sovereign fights have transnational economic intercourse fights vate economic property fights and transnational in international economic in international regulatory states＇ regulatory powers negative coexistence law, and states coordination law. Transnational prirepresent transnational regulatory legal relations between private persons and nation - states, transnational states＇ economic sovereign rights represent legal relations of international economic coexistence among states, and transnational states＇ economic intercourse rights represent legal relations of international economic regulatory coordination （cooperation） among states. These four types of rights and powers categories can integratedly reveal legal relations among various legal subjects of public fransnational economic law and its whole system, and therefore, based on these four cornerstone categories, we can try to construct a more sound and perfect discipline system of international economic law science discipline with public transnational economic law as its perspective.
