论《城乡规划法》“控权”下的控制性详细规划——从“技术参考文件”到“法定羁束依据”的嬗变

摘　　要：相对于《城市规划法》的"赋权"及"管理法"取向,本文认为《城乡规划法》更多体现了"控权"的立法精神及实质性安排;相应地,《城乡规划法》条件下的控制性详细规划已经从政府内部的"技术参考文件"转变为规划行政管理的"法定羁束依据"。本文以行政法学视角为切入点,论述控制性详细规划的演进及地位与作用的嬗变;进而结合法制建设目标及现实发展条件,讨论如何完善控制性详细规划。This paper argues that compared with former City Planning Act, the City and Countryside Planning Act limits the discretional administrative power of local authorities in development permission. Therefore, the role of regulatory detailed plan under the new Act has shifted from technical document to statutory evidence. This paper from the perspective of public administration analyzes the evolution and the transition of role of regulatory detailed plan. Then it presents suggestions on how to improve the regulatory detailed planning in China.
