摘　　要：生产经营者在生产经营过程中因意外事故、安全生产事故、过量地向外界排放"三废"而发生环境污染事故,导致人身伤害和环境破坏,在清理污染过程中又会产生清污费用和污染扩大等后果,为此生产经营者要承担赔偿责任。本文探讨了我国应当实行强制污染损害责任保险制度和强制征收污染损害赔偿基金制度,建立污染损害赔偿体系的问题;阐述了立法目的、研究对象、保险范围、法律的基本原则、当事人权利义务、保险形式、损失范围的审定、赔偿范围、归责原则和政府的责任。The accidents or industrial security accidents and excessively let of ＂three wastes＂ in the production process lead to environmental pollution, human body injuries and damage to the ecology; The production operators are claimed to be taken responsibilities of compensation on the pollution and expenses of cleaning. The legal framework of ＂environmental damage liability insurance law＂ aims to research the＇following subjects：Execute the compulsory liability insurance for pollution damage in China.Execute the compulsory collection of found for damage compensation in China.Set up the compensation system.This law also elaborates the legislative purpose, object of the study, insurance scope, basic principles, rights and obligations of the parties, insurance form, approval of the loss scope, compensation scope, liability principle and responsibility of government.
