摘　　要：人体器官移植是医疗科技的重大成果。与一般医患关系相比,其所涉及的法律关系更为复杂,发生的侵权问题也呈现出特殊性。人体器官移植侵权问题有着深刻的法律、医学乃至伦理根源,我国立法应对器官权的法律地位、死亡标准以及器官资源分配不公等问题进行必要的确认与调整,使器官移植中的侵权现象得到有效的遏制。Human organ transplant operation is a great achievement of human iatrical technology. The legal relationship re- lated to organ transplant is more complicated than common doctor - patient relation, so the tort issue resulting from it ap- pears to be more special. The occurrence of that kind of tort lies deeply in law, medical science and ethics. The legal status of organ right, the standard of death and the unfairness of organ resources distribution should be recognized and adjusted so that the tort in organ transplant can be contained efficiently.
