摘  要:鉴于我国统一行政程序立法尚处于探索阶段,以及证明责任概念的两重性在国内理论界常发生混用的现状,行政程序证据规则应当摒弃证明责任概念。在行政程序证据规则中,应当充分考虑到行政程序法典的统一性、行政行为的非终局性和效能性、行政执法人员的执法水平,直接采用举证义务分配这一概念;行政程序证据中的证明标准应当采用优势证明标准。只要将证明标准贯穿于定案规则之中,将举证义务明确于取证规则之中,将行政程序法的一般理念及其他相关程序制度辅佐于证据制度左右,那么,未来行政程序法典的证据规则将是一个严谨而开放的规则体系。只有这样,行政程序法典的证据规则才是可行的。Through the administrative procedures to comb proof responsibility theory, based on the unified administrative legislative procedure is still in the stage of exploration and the concept of "The burden of proof" often is used incorrectly ,the administrative procedure rules of evidence should be abandoned the burden of proof. Fully considering the unity of the administrative procedure code, the effectiveness of the administrative behavior, and the law enforcement level, we directly use this concept: burden distribution of obligations in administrative procedures. Then we think the administrative procedure shall be adopted the standard of " advantage prove" standards. Standard will be finalized, throughout the rules; the general idea to the administrative procedure and other system will be through the evidence rules. We also specify the main contents that the future evidence rules of the administrative procedure code should contain. It will be a rigorous and open system of rules. Only in this way, the administrative procedure code rules of evidence can be feasible
