摘 要:2005年南京市实行出租车"公车公营"体制,希望一揽子解决出租车行业的顽疾,切实保障劳动者的权益。但一些深层的矛盾并未解决,如司机收入下降、劳动时间延长等劳动权的保障问题,混淆劳动合同与承包合同以及出现了"阴阳合同"的问题,出租车公司利润下降、管理难以到位的问题等等。需要从体制上对此加以变革,引进市场竞争机制,依法规范合同,强化企业的社会责任,界定和平衡各方权益,以实现对出租车司机这一特殊劳动者群体的权益保护。The system of "government operation of taxies" in Nanjing has been implemented since 2005 in order to solve a series of problems of taxi trade and guarantee the rights and interests of employees. However, there are still some contradictions unsolved, for example, taxi drivers' wage is reduced; the working time is extended ; some employers confuse the employment contracts with contracting contract; the taxi corporation's profit is decreased and the management is difficult to be put into effect. Thus, we must push forward reform of the system, introduce mechanism of marketing competition, legally standardize contracts, strengthen enterprises' social responsibility, and define and balance the rights and interests of the parties in order to protect the rights and interests of such employees as taxi drivers.
