摘　　要：数字资源长期保存的基础是国家的缴存制度,但目前我国还没有相应的政策或制度来约束出版者,并存在受缴机构不明确、电子出版物的缴送状况不乐观、出版机构权益与缴存制度相矛盾等问题。通过对国内外法定缴存制度的比较,根据国外缴存制度的最新进展,建议明确受缴主体、改变呈缴机制和方式、扩大缴存内容,以及利用权益保护与补偿机制等方式改进我国现行的缴存制度。The legal deposit system is the basis for the long-term preservation of digital resources, but there have not been corresponding polices or systems to bind the publishers in China, and there are problems of legal deposit system： the deposit institutions are not clear, the deposit of electronic publications are not enough, and there are contradiction between publishers＇ rights and legal deposit system. Through the comparative study on the foreign and Chinese legal deposit system, according to the update development of forgein legal deposit system, the authors propose some suggestions for improving the current legal deposit system in China, such as making clear the subject of the deposit, changing the mechanism and manners of legal deposit, enlarging the scope of legal deposit, using rights protection and compensation mechanism, and so on.
