“生物自然力”的马克思主义解读及其环境法学意义

摘　　要：以马克思主义自然力理论为指导,从碳汇交易、生态补偿、生物安全、生态农业、病虫害综合防治等环境法制研究的热点或准热点问题中剖析出了"生物自然力";探讨了"生物自然力"提出的必要性及其内涵。马克思主义自然力理论的拓展——生物自然力的提出,实现了马克思主义理论与环境法制建设的创新性、具体性衔接,有利于在"自然力——生产力——经济基础——上层建筑"原理基础上,讨论、解决与"生物自然力"有关的中国特色的环境法制建设问题。Under the guidance of the Marxist doctrine on the forces of nature, the present paper puts forward the conception of ＂bio- forces of nature＂ in terms of the heatedly and semi - heatedly discussed issues of environmental legal researches on carbon-currency transactions, eco-compensation, bio-security, eco-agriculture, and comprehensive prevention and cure of plant diseases and insect pests. The expansion of the Marxist doctrine on forces of nature - - - i.e. the coming into being of ＂bio - forces of nature＂ - - - has implemented the innovative and concrete liaison between Marxist theories and the legal system of environment. And this is of course beneficial for discussing and solving, on the basis of the principle of ＂forces of nature- productivity- economic foundation- superstructure, those problems concerning the construction of the legal system of environment with Chinese characteristics＂.
