论我国铁路检察体制改革的必要性及其途径

摘　　要：以上下级检察院之间的业务领导关系和铁路局、铁路分局对检察院的行政领导关系为特征的我国现行铁路检察体制直接阻碍了铁路检察机关检察职能的正常履行。我国铁路检察院的设置初衷已适用不了当前社会发展的需要,有必要对其进行符合宪法精神的铁路检察体制改革。Our current railway prosecutorial railway system directly hinders the normal implementation of prosecutorial functions of the railway proseeutorial organ. It is the reason that our railway prosecutorial system has own characteristic , which is the lower level relations between the business leaders and Railway Administration, Railway Branch of the Public Proseeutor＇s Office characterized the relationship between the executive leadership. The setting of China Railway prosecutorial office has not been applied the current needs of social development,. The reform of our railway prosecutorial system is necessary and must be consistent with the spirit of the Constitution.
