摘　　要：发明专利保护范围是发明专利保护制度的核心,专利保护范围的确定必须严格以专利权利要求书记载的技术特征为准,同时结合发明专利保护范围的解释原则来对发明专利实际保护范围做出清晰的界定。只有这样才能划清专利侵权与否的界限,切实保护专利权人的合法权益,平衡专利权人个人利益和社会公共利益。The protection extent of invention patent is the key part of protection system of invention patent. The determination of the protection extent of invention patent must be strictly based on the technical features specified in the claim. However the clear determination of practical protection extent of invention patent should be made by combining the claim and the interpretation principle of patent protection extent. Only by this way, can the boundary of whether the patent right is infringed or not be clearly defined so that the lawful right and interest of the patentee can be fully protected and the interests of individual patentee and the public can be well balanced.
