摘 要:我国《物权法》确立了业主自行管理、委托物业服务企业或其他管理人管理等物业管理模式。各模式的内涵和外延、适用法律范围以及形成的法律关系均有所差异。其他管理人的范围界定为符合一定资质条件的自然人和非法人组织,设立市场准入制度,完善物业保险制度是其他管理人模式建构的内容。明确业主自治机构法律地位,细化业主委员会的权利与义务及其责任、建立业主自治机构的监督机构为业主自行管理模式完善的关键所在。Rein Law of China has established three property management patterns: the homeowners" management, the residential property management company "s management and other managers" management . There are some similarities and differences of the content and the coverage in the three different patterns. Meanwhile, there do have more differences in the application, the features of the contractual relationship between the homeowners and the property managers under different patterns. Other managers should be natural persons or entities which are qualified with certain certificates but are not legal persons. The content of construction about the other managers'management includes the establishment of market access system and perfection of the property insurance. While the key point of perfection of the homeowners'management is the definitude of the legal status of the autonomous institution of homeowners, the refinement of the rights, obligations and liabilities of the homeowners'association and the establishment of the supervision organization.
