摘　　要：针对我国交通肇事现状,危险驾驶行为按照交通肇事罪加以定罪量刑,不能体现罚当其罪。建议在立法上增设"危险驾驶罪",将危险驾驶行为犯罪化,以明确国家对此类行为的否定性评价,从而对危险驾驶行为进行有效遏止,实现公平正义。The article is based on the constitutive elements of Crime of Causing Traffic Casualties, and compares with the Crime of Intentionally Endangering Public Security by Using Other Dangerous Means. Because the laws and regulations in China do not clearly define the drag racing, we believe that legislative branches should legislate against Dangerous Crime of Causing Traffic Casualties. In this way, the Criminal Law of the PRC will clearly state the negative evaluation of such actions and plays an increasingly important role in fighting against dangerous driving.
