宏观视野看中国金融法律制度的完善——以金融控股公司立法为例

摘　　要：这次国际金融危机暴露出西方国家在金融法律制度上的漏洞和不足,为我国进一步完善和健全金融及相关法律制度提供了一个很好的教材。要从宏观视角重新描绘我国金融法律制度的理论图谱,完善金融立法上的诸多空白,通过法定程序修订不适应金融业经营监管需要的现行法律法规,推动我国金融业依法经营监管和法治建设向纵深发展。The international financial crisis has exposed the lack and loopholes of the financial laws system in the western countries, for our country provides an excellent teaching material to further refine and improve the financial and related legal system. From the macro perspective the paper re-portray the theory map of the China＇s financial legal system and improve a number of blank in financial legislation. For the existing laws and regulations that not meet the needs of the financial sector regulatory, amendments should be timely make to the relevant promote the China＇ s financial sector legitimate operation regulation authorities through legal procedures, in order to further and building of the rule of law to develop in depth.
