摘　　要：对数字图书馆建设中出现的一些法律问题,如著作版权问题、图书馆的公益性和商业性冲突中的法律较量、网络资源中的侵权等,应当借助于法律本身来寻求合理解决,同时采用"新、老五定律"来规范和平衡数字图书馆的公益性和商业性,从而保证数字图书馆的健康发展。To reasonably deal with the issues raised in the process of digital library establishment, such as the copyright issues of works, the legal contest in the conflict between nonprofit and commercial nature of the library, the infringement in network resources, law itself should be resorted to. Meanwhile, ＂ Old and New Five Laws＂ should also be employed to regulate and balance the nonprofit and commercial nature of digital libraries so as to guarantee the healthy development of digital libraries.
