摘 要:关于精神障碍者过失的认定,西方国家的侵权法所采取的,大体上分为主观标准体制和客观标准体制。此外,欧洲在这一领域的两部法律"草案"中提出了值得关注的折中方案。原则上在确定精神障碍者的过失时应采用客观标准,但对于在行为时完全不能认识行为性质的人,或者因不可抗力而发生精神障碍并导致损害的人,允许依据其赔偿能力和案件的其他相关情况减轻或免除其责任,不过,对因故意或过失使自身陷于精神障碍的,不应减免其责任。With regard to determination of mentally disabled persons' negligence, measures adopted by tort laws in western countries can basically be categorized into subjective standard system and objective standard system. In addition, European legal "drafts" within this realm have raised a compromise solution, which deserves close attention. From the authors' point of view, in principle, objective standard is supposed to be applied while determining the negligence of persons with mental disability, but exceptions can be made with respect to those who, at the time of behaving, are totally not able to recognize their conduct, or those who suffer from mental disability and subsequently cause harm due to force injures, that is, liabilities are allowed to be mitigated or exempted according to their capacity to compensate and other relevant circumstances. However, as to those who have intentionally or negligently plunged into mental disability, liabilities are not expected to be mitigated or exempted.
