少数民族习惯法中的公共事务管理权利——以拉祜族“卡些”为例

摘　　要：少数民族习惯法是"民间"的法,对民族社区社会关系调整、对少数民族权利保障发挥着不可替代的作用。拉祜族的"卡些"组织是依据拉祜族传统习惯法组织的与村民委员会并行的公共事务管理机构,村民依据习惯法享有完整的选举、被选举、罢免"卡些"组织成员的权利。"卡些"制度在当今拉祜族村寨社区内可以补充依据国家法律建立的村民委员会组织等自治组织对公共事务管理方面的空白,在公共事务管理以及解决纠纷方面发挥重要作用。Minority custom law is the law of the ＂civil＂ . It plays important role in the adjustment of social relations in ethnic region and minority right safeguard. The ＂Kaxie＂ organization of the Lahu nationality is public administration organization that rests on the Lahu＇ s minority tradition common law and parallels with the villagers committee. The villagers have the integrity election right, the elected right and the right to recall members of the organization. The system on ＂Kaxie＂ may supplement blank about the public administration of autonomous organization which established on the basis of country law in Lahu committee. It plays the vital role in the public administration as well as the solution dispute aspect.
