摘　　要：现实婚姻生活中的侵权行为,严重地侵害了被侵权人的合法权益,危害着婚姻家庭关系的健康和稳定。婚姻中的夫妻往往被人们视为一个共同体,而忽视对夫或妻个体人格的关注,但在这个共同体中,既有共同体的共同利益,又有夫妻各自独立的权益。作为婚姻权利的救济措施,夫妻侵权民事责任制度对保护婚姻当事人合法权益有重要意义,应当在婚姻家庭法中进一步完善。The reality of married life violations, serious violations have been infringing the legitimate rights and interests, endanger the health of marriage and family relations and stability. Husband and wife in marriage is often seen as a community to the neglect of the individual personality of concern. But in this community, husband and wife have independent personality. In marriage, individual fights should be respected. The protection of the rights of the individual is important, it should be in marriage and family law further improved.
