探析言论自由入诽谤罪之原因及解决对策

摘　　要：公民的言论自由是一个国家宪法所赋予的基本权利之一,也是衡量一个社会民主化程度高低的一杆标尺。在建设法治社会、构建和谐社会的今天,各级政府更应最大限度地保障公民的言论自由,不仅要能够容纳不同呼声的存在,更应该正视和尊重不同的呼声,为人民广开言路,让人民畅所欲言,以保证公民这一宪法权利的实现。视公民的言论自由如洪水猛兽,动辄采取高压手段予以打压的做法,自然是对公民基本权利的践踏,为民主政治社会所不齿。Freedom of speech is one of the fundamental civil rights granted by national constitution, and also a criteria to measure the democratic level of a society. Today in the construction of nomoeraey and harmounious so- ciety, all levels of governmental should guarantee civil freedom of speech to the utmost, not only be able to toler- ate but also to face and respect different opinions, broaden the paths for freedom of speech, encourage people to say their say, so that this civil right assignned by constitution ean be fully implemented. The modus operandi to regard civil freedom of speech as great scourges and to repress civil freedom of speech by strong force is definitely a trample upon basic human rights and is surely despised by democratic society.
