摘　　要：知识产权的公共领域是被广泛使用的概念,具有保护的法理学根据,但人们却常常忽略了对它的保护。在知识产权日益膨胀的今天,越来越多的公有资源被个人所垄断,发达国家也多利用知识产权限制发展中国家的发展,掠夺其丰富的非物质财富。公共领域面临的现实危机需要我们对其进行保护,以保证知识产权创造的源泉。The public field of intellectual rights is a widely used concept; and has the protection basis of jurisprudence, but its protection is always ignored. Nowadays, intellectual rights is expanding and more and more public resources are monopolized by individuals, and developed countries limit the development of developing countries by intellectual rights to despoil the abundant immaterial wealth. The realistic crisis that public field faces needs our protection in order to guarantee the creativity source of intellectual rights.
