对犯罪动机概念的质疑——关于犯罪心理学基本理论问题的探讨

摘　　要：针对犯罪动机概念内涵不清、应用混乱的状况,文章对犯罪动机概念提出本质和界定方面的质疑。犯罪动机是犯罪行为发生、发展和完成的内部起因;预期的犯罪目的是犯罪动机的根本属性;犯罪动机不是犯罪行为的共同属性,而应该是犯罪心理学的通用概念;犯罪动机概念应修订为犯罪的动机,可划为犯因性动机、一般性动机、无意识动机和有意犯罪动机、模糊犯罪动机、无意犯罪动机两大类。In accordance with the situation of the unclear concept of criminal motives and the confusion of application, the article provides the question of notions on the nature and motive of the definition. Motive of the crime is the internal causes of a crime’s development and completion; expected motive of the crime of criminal purpose is a fundamental property; motive of the crime is not a common property crime and therefore should be a crime, a common psychological concept; the concept of motive of the crime as a crime should be amended to motivation, and can be classified as guilty of criminal motivation, general motivation, unconscious motives and intentional motive for the crime, fuzzy motive of the crime.
